Overview

These Terms of Service (“Terms”) govern your access to and use of the website, content, features, tools, products and services provided by Glame It Beauty Limited (“Glame It”, “we”, “us”, or “our”) (collectively, the “Services”). Our store is hosted on Shopify Inc. which enables us to provide the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility; Accounts

  • You represent that you are either (a) the age of majority in your place of residence and legally capable of entering a binding contract, or (b) a teenager aged 13–17 using the Services with the consent or supervision of a parent or legal guardian, who accepts these Terms on your behalf.
  • You agree to provide accurate, current, and complete information and to keep your account details secure. You are responsible for all activity that occurs under your account.
  • You may not transfer, sell, assign, or license your account to any other person.

2. Product Information & Safety (Beauty Products)

  • We strive to display product colours, styles, and specifications accurately; actual appearance may vary due to device settings.
  • No medical claims: our products are cosmetic/beauty items. They are not intended to diagnose, treat, cure, or prevent any disease. Discontinue use if irritation occurs. Patch test adhesives/liners as directed.
  • Descriptions, pricing, and availability are subject to change without notice. We may limit quantities per person/household/order or by region.

3. Orders & Acceptance

  • Your order is an offer to purchase. We may accept or decline any order at our discretion. We will confirm acceptance only after payment is processed.
  • Review your order carefully before submitting; cancellations may not be possible once an order is accepted.
  • Purchases are for personal use only and not for resale or export without our prior written consent.
  • Returns/exchanges are governed by our Returns & Refunds Policy.

4. Prices, Taxes & Billing

  • Prices, discounts, and promotions may change without notice. The price charged is the one shown at checkout at the time of purchase.
  • Unless stated otherwise, prices exclude shipping, handling, duties, customs, and applicable taxes (e.g., NZ GST / AU GST where applicable). These will be calculated at checkout or collected on delivery by customs.
  • You agree to provide valid payment details and authorise us (and our payment processors) to charge your method of payment for the total order amount.

5. Shipping, Delivery & Risk of Loss

  • Shipping and delivery times are estimates and not guarantees. We are not responsible for delays caused by carriers, customs, or events beyond our control.
  • Risk of loss and title pass to you when we deliver the items to the carrier.
  • International customers are responsible for any import duties, taxes, and fees imposed by the destination country.

6. Returns & Hygiene Policy

  • For health and hygiene reasons, opened or used magnetic lashes, magnetic eyeliners/adhesives, or lash tools cannot be returned.
  • Unopened items may be returned within the timeframe and conditions set out in our Returns & Refunds Policy.

7. Promotions, Discount Codes & Gifts

  • Promotions/codes are subject to separate terms. Unless stated otherwise, promotions are non-transferable, cannot be combined, and are not redeemable for cash.
  • If you return items purchased with a code, the refund will reflect the discounted amount actually paid.

8. Intellectual Property

The Services and all content (including trademarks, logos, product names, text, images, graphics, video, and audio) are owned by Glame It, Shopify, or respective licensors and are protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial use only. No rights are granted except as expressly set out in these Terms.

9. User Content & Reviews

  • If you submit reviews, photos, comments, or other content (“User Content”), you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, and display such content for any lawful purpose (including marketing), in any media.
  • You represent that you own or control all rights in your User Content, it is accurate, and it does not infringe any third-party rights or contain unlawful material.
  • We may moderate, edit, or remove User Content that violates these Terms or applicable law.

10. Optional Tools & Third-Party Links

We may provide access to third-party tools or link to third-party sites. Such tools/sites are provided “as is” and are not under our control. Your use is at your own risk and subject to the third party’s terms and privacy policies.

11. Relationship with Shopify

We are powered by Shopify, but sales are made by Glame It. Shopify is not responsible for your purchases or any issues arising from them. You release Shopify from claims arising out of your transactions with us.

12. Privacy

Personal information is handled in accordance with our Privacy Policy and, where applicable, Shopify’s privacy policy. By using the Services, you acknowledge these policies.

13. Prohibited Uses

You may not use the Services for unlawful, harmful, or abusive activities; to infringe intellectual property; to transmit malicious code or spam; to scrape, crawl, or harvest data; to bypass security; or otherwise interfere with the operation of the Services.

14. Termination

We may suspend or terminate access to the Services at any time for any reason. Sections that by their nature should survive termination will continue to apply.

15. Disclaimer of Warranties

Except to the extent required by law or expressly stated by us, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, title, and non-infringement). We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

16. Limitation of Liability

To the fullest extent permitted by law, Glame It and our directors, officers, employees, partners, agents, contractors, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or products, even if advised of the possibility. Nothing in these Terms limits your non-excludable rights under the New Zealand Consumer Guarantees Act 1993 or Australian Consumer Law.

17. Indemnification

You agree to indemnify and hold harmless Glame It (and Shopify), and our affiliates, officers, directors, employees, agents, and service providers from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, violation of law, or misuse of the Services.

18. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force.

19. Waiver; Entire Agreement

Our failure to enforce any right is not a waiver. These Terms, together with policies referenced herein (including our Privacy Policy and Returns & Refunds Policy), constitute the entire agreement between you and us regarding the Services.

20. Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

21. Governing Law & Jurisdiction

These Terms are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand. Australian consumers: nothing in these Terms limits any rights you have under the Australian Consumer Law.

22. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated “Last updated” date and, where required by law, we will provide additional notice. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
